PediJurnal terms of service
1. The parties
PediJurnal is a web app provided by Promotion Performance SRL, with its registered office in Târgu Mureș, Romania (“we” or “us”). The office is a registered seat, not an office open to visitors. You can email us at any time at motion@promotioncreative.ro.
The contract is with the podiatry or medical-pedicure practice that creates an account (“you”). PediJurnal is a service for professionals, not for consumers. The person who creates the account confirms that they are authorized to enter into this contract on behalf of the practice.
The data processing agreement is part of this contract.
2. The service
PediJurnal helps you keep your practice’s records: patient identity and contact details, medical history, visit findings, foot photos, signed consents, appointments, payments per visit, and expenses.
PediJurnal does not give medical advice. The practitioner makes the clinical decisions and is responsible for them.
For patient reminders, the app only prepares the text. You send the message yourself, from your own WhatsApp or SMS app. PediJurnal does not send messages to patients.
3. Your account
- The details you give when you sign up must be accurate and kept up to date.
- Each team member uses their own account. Don’t share passwords.
- You are responsible for what is done through your team’s accounts. If you suspect someone has accessed an account without permission, tell us right away.
4. Free trial and subscription
- After you sign up, you get a 14-day free trial.
- After that, you can continue with a monthly or yearly subscription, paid through Stripe. Card details go only to Stripe. We don’t see or store them.
- The subscription renews at the end of each period (month or year) until you cancel it.
- When the trial or the subscription ends, your data stays in the account. You can read and export it, but you can no longer edit it.
5. Prices and VAT
You see the price on the checkout page before you confirm. The checkout page also shows whether the price includes VAT. VAT is applied as the law requires. We issue invoices under Romanian law.
If we change the price, we’ll email you at least 30 days before the new price applies to your subscription.
6. Cancellation
You can cancel your subscription at any time in the Stripe customer portal. The portal shows the date the cancellation takes effect. After that date, your data stays available to read and export, as described in section 4.
7. Acceptable use
Use PediJurnal only for your practice’s work and only lawfully. You may not:
- upload data you have no right to process;
- try to get around security measures or access other practices’ data;
- deliberately overload the service or use it for cyberattacks;
- resell access or give it to people outside your practice.
8. Your responsibilities
- For patient data, your practice is the controller, and we are the processor (GDPR Article 28). You need a lawful basis for all processing, including health data and photos.
- You inform your patients about how their data is processed and obtain any consents the law requires.
- You are responsible for clinical decisions and for the accuracy of the data you enter.
- The messages you send to patients from your own phone are your responsibility.
- If the law requires you to keep medical records for a set period, keep an export before you delete data or your account.
9. Availability
We work to keep PediJurnal running without interruption, but we don’t promise a specific uptime percentage. There may be breaks for maintenance or because of faults. When we can, we announce planned maintenance in advance. We recommend that you export your data regularly.
10. Data export and termination
- You can export a single patient or your whole practice as a ZIP file at any time.
- Items you delete go to the archive, where you can restore them for 30 days. After that, they are erased for good.
- You can delete your practice account at any time. Before you do, we offer you an export. Then all data is erased at once. Backups, if any, are overwritten within 30 days at most.
- We may suspend or close your account if you seriously breach these terms. Except in urgent cases, we’ll warn you first and give you time to export your data.
11. Limitation of liability
Our total liability to you is limited to the amount you paid for PediJurnal in the 12 months before the event that caused the damage.
This cap does not apply where the law does not allow liability to be limited, for example for damage caused intentionally or through gross negligence.
12. Changes to these terms
If we change these terms, we’ll tell you by email and in the app at least 30 days before the change takes effect. If you don’t agree, you can cancel your subscription before that date. Changes required by law may apply sooner.
13. Governing law and disputes
This contract is governed by Romanian law. If a disagreement comes up, please write to us first so we can try to settle it amicably. Disputes go to the competent courts at our registered office, without prejudice to mandatory legal rules.
These terms are available in Romanian, Hungarian, English, and Spanish. If the versions differ, the Romanian version prevails.
